Jimmy McMillan evicted, Jimmy McMillan, 'rent is too damn high' candidate, faces eviction. Manhattan landlord says tenant really lives in Brooklyn. The rent at Jimmy McMillan’s East Village apartment is not too damn high — and that’s why his landlord wants the former fringe candidate evicted.
The one-time gubernatorial hopeful was back in Manhattan Housing Court on Wednesday, battling to stay in his $872-a-month rent-stabilized one-bedroom home.
McMillan — his distinctive white hair combed back — insisted he was living at the Manhattan apartment while using a second address in Brooklyn as an office.
But his landlord countered that McMillan is improperly using the Manhattan apartment as an inexpensive residence for his 32-year-old son, Jimmy McMillan IV.
Estimates are that the landlord could rent the apartment for nearly three times as much as McMillan pays.
At a hearing that took some bizarre turns, the quirky ex-candidate acknowledged that he hasn’t paid federal incomes taxes for years. His fight with the IRS over taxes dates back to 2005.
“I can file them this week,” McMillan told Judge John Henry Stanley, who informed the cult hero that it was too late for that.
McMillan, dressed in a dark gray suit and wearing a lapel button featuring his own profile, insisted his dual-borough existence began after a 1993 murder attempt.
He wound up doing odd jobs in Brooklyn in return for a free apartment on Nostrand Ave., and eventually began using the space as an office, McMillan said.
Although he even registered to vote using the Brooklyn address, McMillan insisted that he always lived in Manhattan — and produced a driver’s license featuring his St. Mark’s Place address.
McMillan admitted temporarily vacating the apartment to give Jimmy III and his girlfriend some privacy. But McMillan said he was moving back in after his son’s military enlistment kicks in next month. jimmy mcmillan eviction, jimmy mcmillan rent apartment,
Stanley ordered McMillan to turn over a variety of documents to his landlord’s lawyer, Stephen Shulman, by Dec. 21 as the eviction battle continues.
